Vehicle Rental Agreement

This is a reference copy. The binding agreement, with your details filled in, is presented and signed at the time of booking.

This Vehicle Rental Agreement ("Agreement") is made between Elite Car Plug ("Owner") and the renter identified at booking ("Renter"). By signing, Renter agrees to every term in this Agreement.

1. Renter Information

The Renter provides their full name, phone number, email address, home address, and driver's license number at the time of booking.

2. Vehicle

The specific vehicle (make/model, VIN, and license plate) is identified on the booking confirmation.

3. Rental Period

The rental start and end dates and times are set at booking. The vehicle must be returned by the end date and time. Renter acquires no ownership interest and may not extend the rental without Owner's written approval.

3A. Cancellations and No-Shows

Cancellations made at least 48 hours before the scheduled pickup receive a full refund of any prepayment. Cancellations between 24 and 48 hours before pickup receive a 50% refund of any prepayment. Cancellations less than 24 hours before pickup, and no-shows, are non-refundable and may be charged up to one day's rental rate. Any authorized security deposit is released for a cancelled rental. Specific bookings may carry different cancellation terms, which are shown at the time of booking.

4. Charges and Payment

The rental fee, taxes, security deposit, and any additional fees are shown at booking. Renter authorizes Owner to charge the payment method on file for all rental fees, taxes, the deposit, and any additional charges, fines, tolls, late fees, or damages that arise under this Agreement.

5. Security Deposit

A refundable security deposit is held at the start of the rental and refunded within 5 business days after return, less any amounts owed for damage, missing fuel, excess mileage, late return, cleaning, tolls, citations, or other charges under this Agreement.

6. Mileage

Each rental includes a mileage allowance shown at booking. Miles driven beyond the allowance are charged at the per-mile overage rate set for that vehicle. Odometer readings are recorded at pickup and return.

7. Fuel

The vehicle must be returned at the same fuel level it was provided. If returned with less fuel, Renter will be charged for the fuel shortfall plus a $25 refueling service fee.

8. Authorized Driver

Only the Renter named on the booking may operate the vehicle. Renter must be at least 21 years old and hold a valid, unexpired driver's license. Allowing anyone else to drive the vehicle without Owner's prior written consent is a breach of this Agreement and voids any protection it provides.

9. Permitted Use and Restrictions

The vehicle may be used only for lawful, personal transportation. Smoking and vaping inside the vehicle are strictly prohibited, and a $250 cleaning fee applies to any violation. Renter shall NOT: use the vehicle for any illegal purpose or to transport anything in violation of law; use it for rideshare, delivery, hire, or any commercial purpose without Owner's written consent; sublet, re-rent, or lend the vehicle to anyone; operate it while impaired by alcohol, drugs, or any other substance; use it for racing, speed contests, towing, or off-road driving; or transport pets without Owner's consent. Out-of-State Travel: the vehicle may not be driven outside the State of Oklahoma unless Renter first obtains Owner's written approval in advance and pays a $150 out-of-state travel fee.

10. Insurance and Financial Responsibility

Renter is responsible for the vehicle during the entire rental period. Renter represents that they carry valid auto insurance that applies during this rental and is primary. Renter is financially responsible for all loss of or damage to the vehicle regardless of fault, including theft, vandalism, collision, damage from misuse, towing, storage, diminished value, and lost rental income while the vehicle is repaired.

10A. Optional Third-Party Insurance and Assumption of Liability

Before taking possession of the vehicle, Renter has the option, at Renter's own expense, to obtain third-party automobile insurance covering operation of this vehicle, including liability for bodily injury and property damage; proof of active coverage must be provided before the rental begins. Renter elects or declines this option in writing at signing. If Renter declines third-party insurance, or fails to keep it active during the rental period, Renter knowingly and voluntarily accepts full responsibility and liability for any loss, damage, injury, or claim arising while the vehicle is in Renter's possession or control, including but not limited to: (a) any damage to, loss of, or theft of the vehicle; (b) damage to any other property, whether belonging to Owner, Renter, or any third party; and (c) any injury to or death of any person, including Renter, passengers, and any other people. To the fullest extent permitted by law, a Renter who declines insurance agrees to defend, indemnify, and hold Owner harmless from all claims, damages, losses, liabilities, fines, costs, and expenses (including reasonable attorney's fees) arising from Renter's use of the vehicle, except to the extent caused by Owner's own gross negligence or willful misconduct.

11. Condition at Pickup and Return

The vehicle is rented in good working condition. Renter has inspected it and agrees it is free of damage except as documented at pickup, and agrees to return it in the same condition, ordinary wear excepted.

12. Accidents, Damage, and Citations

Renter must immediately notify Owner, and the police where applicable, of any accident, theft, damage, or breakdown, and must not leave the vehicle unsecured. Renter is responsible for all tolls, parking, traffic, and other citations incurred during the rental, plus a $50 administrative fee per citation.

13. Late Return

A grace period of up to 30 minutes applies. 31 to 60 minutes late: $50. More than 1 hour and up to 2 hours late: $100. More than 2 hours late: one additional full rental day charged at the daily rate. Failing to contact Owner about a late return adds a $50 administrative fee. If the vehicle remains overdue, Owner may recover it at Renter's expense.

14. Default and Repossession

If Renter breaches any term, Owner may terminate this Agreement immediately, recover the vehicle at Renter's expense, and charge Renter for all resulting costs.

15. Indemnification

Renter agrees to indemnify and hold Owner harmless from any claims, damages, fines, losses, or expenses, including reasonable attorney's fees, arising from Renter's use of the vehicle or breach of this Agreement.

16. Governing Law

This Agreement is governed by the laws of the State of Oklahoma, United States, and any dispute will be resolved in the state or county courts located in Oklahoma.

17. Acknowledgment

By signing, Renter confirms they have read, understood, and agreed to all terms of this Agreement and that the information they provided is accurate.
